Who is very familiar with and trained in handling a mountain bike or hiking equipment.
Has a lot of experience in the respective sport.
Is aware of the dangers of the activity and behaves accordingly.
Behaves in such a way that damage to nature, forests, animals and people is avoided.
Has become sufficiently familiar with the rules and regulations on Corsica that affect the respective sport.

All publications have been checked several times on site by the author. Nevertheless, he cannot guarantee that all routes of the tours are always safe to drive on. Particular attention should be paid to unforeseeable situations such as:

Influences due to current weather conditions, e.g., ice and rain
The impassability of paths, e.g., due to fallen trees
The blocking of paths or changes to the routing, e.g., by forestry offices
The misconduct of third parties, e.g., hunting accidents
Hazards due to deterioration in the road condition, e.g., due to road damage and potholes, forestry work, natural damage or road and repair work.

This also applies to situations that arise from misconduct or the incorrect assessment of the circumstances by the user himself.

The user must be aware that he shares the routes with other athletes and those looking for relaxation and must behave accordingly carefully and considerately. For the reasons mentioned above, we strongly recommend that users take out adequate liability insurance.

 

Legal framework

When creating the tours and the published accompanying materials, the laws and regulations underlying their use were observed.

The author points out that the laws on which the use of the areas is based must always be observed in their currently valid version.

 

Care

The author assures that he has created all tours to the best of his knowledge and belief and in compliance with all due diligence. This also applies to the creation of all materials published on https://corsica-outdoor.org.

Nevertheless, it should be pointed out that every tour requires thorough preparation by the user and that, in particular, walking or driving on a route for the first time requires special attention and caution.

 

Adjustment clause

The operator of the website https://corsica-outdoor.org reserves the right to supplement or change the tours and the accompanying materials.

A reason for this may be, among other things:

Changing the legal requirements for the use of included paths
A permanent change in the road network
Change of usage rights for included paths
Permanent impassability of paths
A permanent closure of paths

The operator also reserves the right to reverse the publication of a tour. In such a case, material that has already been downloaded may not be used further. It is up to the user to take care to inform themselves about this and to only ever use the published material in its current version.

The operator expressly reserves the right to change, supplement or delete parts or the entire offer or to temporarily or permanently cease publication without prior notice. In this case, too, material that has already been downloaded may not be reused.

 

Supplementary Material

Although GPS tracks are available for download on the website https://corsica-outdoor.org, the operator recommends that you always take additional paper maps with you on a tour. This is useful in such cases, among other things, when – the GPS cannot be used, e.g., in bad weather or a technical defect. – the route has to be changed, e.g., due to the closure of paths or natural phenomena.

 

Legal effect

The present terms of use are to be regarded as part of the website and the publications and materials (photos, maps, tour profiles, GPS tracks, etc.) offered for download there. If parts or individual formulations of this text do not, no longer or not completely correspond to the applicable legal situation, the remaining parts remain unaffected in their content and validity.

 

LICENSE AGREEMENT FOR CORSICA OUTDOOR CONTENT

This part of the document is a license agreement between you and Corsica-Outdoor that explains how you can use photos, graphics, vectors and video clips that you license from Corsica-Outdoor. By downloading content from Corsica-Outdoor, you agree to the terms of this Agreement.

What types of licenses does Corsica-Outdoor offer?

Corsica-Outdoor offers two types of licenses: Standard Licenses and Extended Licenses. Each file downloaded from Corsica-Outdoor includes a standard license. An Extended License grants you additional rights; an additional license fee is payable for this license. If you do not purchase an extended license, your rights of use result from the standard license conditions.

You can purchase licenses for files directly or in the near future with a subscription from Corsica-Outdoor.

You are welcome to use watermarked content from the Corsica-Outdoor website for free solely to create and test a layout draft (associated with other content). Watermarked Content may not be used in Final Materials or Publicly Available Materials and may only be used for a period of 30 days after download.

    

How can I use licensed content?

You may use Content in any way that is not restricted (see “Restricted Uses” below). Subject to these limitations and the remaining terms of this Agreement, Corsica-Outdoor grants you the following rights of use:

Unlimited in time, d. i.e. there is no expiration or end date for your rights to use the Content downloaded during the term of your Agreement.

Non-exclusive, i. that is, you do not have exclusive rights to use the content. Corsica-Outdoor can also license the same content to other customers.

Worldwide, i.e. That is, content may be used in any geographic area.

Unlimited, i. This means you can use the content in an unlimited number of projects and in any media.

 

In this Agreement, “use” means: copy, reproduce, modify, edit, synchronize, perform, display, broadcast, publish or otherwise exploit.

Examples of how you may use Licensed Content include: websites; blog entries; social media; Advertising; marketing campaigns; company presentations; Newspapers, magazines, books, film and television productions; web and mobile applications; product packaging.

 

Please be sure to read the Restricted Uses section below for exceptions.

Restricted Uses.

No Unlawful Use. You may not use the Content in a manner that is pornographic, defamatory, or otherwise unlawful, incites violence or hatred, or in violation of applicable statutes or industry regulations.

No commercial use of content marked as “editorial”. Content marked as “editorial” may not be used for any commercial, promotional, advertorial, sponsorship, advertising, gambling/betting or merchandising purpose unless Corsica-Outdoor has stated in the invoice, offer or in corresponding additional rights are granted in a separate license agreement. This type of content does not include a model or property release and is intended primarily for editorial use, i.e. H. for descriptive purposes such as news reporting and discussion of current events or other topics of general interest (e.g. in a blog, textbook, newspaper or magazine article).

No use as a single file. You may not use Content in a manner that would allow others to download, extract, or redistribute Content as a separate file (that is, just the content file itself, separate from the project or end-use).

No use in trademarks or logos. Unless you obtain a specific license to do so, you may not use any Content (in whole or in part) as a distinctive or distinguishing feature of a trademark, identifier, company name, product or service name, or logo. In addition, you are not entitled to register (in whole or in part) such content as a registered trademark (in any country) or rely on such registrations, prior use and/or the goodwill arising in order to authorize use of the content or related content (including by us, our customers or the owner of the copyright of this content) by third parties.

Sensitive use notice required. If you use content that depicts models or objects in connection with a topic that would seem unfavourable or unduly controversial to a ordinary viewer (such as STDs), you must identify: (1) that the content is for illustrative purposes only and (2) any persons depicted in the Content, if any, are models. A possible wording would be: “Agency photo. Posed with model.” Content marked “editorial” that is used for reporting does not require such a notice.

No misrepresentation of authorship. You may not impersonate any End Use that consists essentially of Licensed Content. For example, you are prohibited from creating a painting based solely on licensed content and then claiming that you are the creator.

Restrictions on Use – unless an Extended License has been purchased. Extended licenses can only be purchased for individually named files.

Unlimited for electronic products such as mobile applications and electronic templates.

No products for resale. Without an Extended License, you may not use any Content for resale goods or services whose value consists primarily of the Licensed Content; such as greeting cards, stationery, paper products, calendars, apparel, posters (printed on paper, canvas, or other media), CDs, DVDs, mobile applications, NFTs, or other items for resale, license, or any other commercial form of sales. This also includes “on-demand” products (i.e. products where the content is selected by a third party to customize the product) such as, but not limited to, postcards, mugs, t-shirts, posters and other items (this also includes selling products through custom designed websites or websites such as zazzle.com or cafepress.com).

No electronic templates. Unless you acquire an Extended License to do so, you may not use Content in electronic or digital templates intended for resale or other distribution (such as templates for websites, business cards, electronic greeting cards, brochure designs).

Limited print run. Unless you acquire an Extended License, you may not reproduce the Content more than 500,000 times for physical prints. This restriction does not apply to electronic reproduction.

No use for machine learning, AI or biometric technology. Unless expressly authorized by Corsica-Outdoor, you may not use any Content (including any caption information, keywords or other metadata associated with the Content) for any machine learning or artificial intelligence and/or any technology designed or intended to identify any individual are. In addition, Corsica-Outdoor does not guarantee that such uses have the consent of the persons concerned, even if a model release is available for the content.

    

Who but myself can use the Licensed Content?

The rights granted to you are non-transferable and non-sublicensable. This means that you may not transfer or sublicense the rights granted to you to anyone. There are two exceptions to this:

Employer or customer. If you are making the purchase on behalf of your employer or client, your employer or client can use the content. If you do so, you represent and warrant that you have full legal authority to require your employer or client to comply with the terms of this Agreement. If you do not have this authority, your employer or client may not use the content.

Subcontractor. You may allow subcontractors (such as your printer or mailing service) or distribution partners to use Content in any production or distribution process related to your end project or end use. These subcontractors and distributors may not use the Content for any other purpose.

Please note that seat/user restrictions apply. You may only use the Content with a corresponding number of users, as explained in Section below.

Are there any workstation/user restrictions?

Yes. The standard license is for a single user. The seat/user restrictions apply to the raw content file, not the end project or end use.

You may share content within your legal entity, but the content must be available to only one person at a time. Unless you purchase an Extended License, you may not store the Content on a server (allowing multiple people to access a given Content at the same time).

If you have licensed the content with a subscription, this means that only one person (the same person) can access, license and use the content.

If more than one user needs to be able to access the content, the following applies:

Extended License Unlimited users within one legal entity. Content may be stored on legal entity servers.

 

User accounts.

You are responsible for tracking all activity under your user accounts and you agree to: (1) maintain the security of all passwords and usernames, (2) immediately notify Corsica-Outdoor of any unauthorized use or other breach of security, and (3) accept full responsibility for the activities that occur through your user accounts. Corsica-Outdoor reserves the right to monitor downloads and user activity to ensure compliance with the terms of this Agreement. Should Corsica-Outdoor determine that you are in breach of this or any other provision of this Agreement, Corsica-Outdoor may block access to your account and take further legal action.

    

Intellectual Property Rights.

Who owns the content?

All Licensed Content is either the property of Corsica-Outdoor or the property of the artists providing the content. All rights not expressly granted in this Agreement are reserved by Corsica-Outdoor and the content suppliers.

 

Indication of the author.

Do I have to indicate the originator of photos? Commercial use does not require attribution, but if you use content for editorial purposes, you must include the following attribution in close proximity to the content or in the attribution for visual material: “Corsica-Outdoor.org .”

Termination/cancellation/withdrawal.

 

Termination.

Except for subscriptions, this Agreement will survive until terminated by either party. You may terminate this Agreement by discontinuing use of the Content and deleting or destroying all copies. Corsica-Outdoor may terminate this Agreement at any time if you breach any provision of this Agreement. In this case, you must immediately stop using the content, delete or destroy all copies of it and, if requested, confirm in writing to Corsica-Outdoor that you have complied with these requirements.

Termination of Subscriptions. Unless renewed, subscription agreements automatically terminate at the end of the subscription period. Corsica-Outdoor may terminate all licenses prior to the expiration of the subscription period to the extent that the company has reason to believe that there has been a breach of any provision of this Agreement or misuse of the subscription account. If you do so, you must immediately stop using the Content, delete or destroy all copies, certify in writing to Corsica-Outdoor that you have complied with these requirements, and pay to Corsica-Outdoor all amounts due at the end of your subscription period, as shown on your invoice stated, still owe.

Social Media Termination. If you use the Content on a social media platform or other third-party website and that platform or website uses (or announces such use of) the Content for its own purposes or in a manner contrary to the terms of this Agreement, this Agreement shall terminate Agreement effective immediately.

 

Refund/Cancellation.

Subscription Refunds – Subscriptions can be refunded within 14 days of the date of your invoice, provided you have not downloaded any content.

Refunds for file downloads – Corsica-Outdoor does not offer refunds for downloaded files. A return of files will only be considered due to technical issues with the file at the sole discretion of Corsica-Outdoor.

Refund/cancellation requests must be in writing. If the request is approved, Corsica-Outdoor will credit your account or credit your credit card with the relevant amount. In the event of cancellation, your rights to use the Content will end and you must delete or destroy all copies of the Content.

 

Retire Content.

Corsica-Outdoor may, in its sole discretion, discontinue licensing any particular content at any time. After notification by Corsica-Outdoor or after you have become aware that content may be subject to claims for infringement of third-party rights for which Corsica-Outdoor may be liable, Corsica-Outdoor may require you to immediately and cease, at your own expense, all further use of such content, delete or destroy all copies, and ensure that your customers, distributors, and employers take the same actions. Corsica-Outdoor will make available to you, free of charge, replacement Content selected by Corsica-Outdoor in its sole commercial discretion and subject to the other terms of this Agreement.

    

Warranties.

Corsica-Outdoor assumes the following guarantees:

Guarantee of Non-Infringement. Unless the relevant Content is marked as “editorial”, your use of the Content under this Agreement and in the form made available to you by Corsica-Outdoor does not violate any copyright, moral right, trademark or other intellectual property right and no right of privacy or publicity, and all model and property releases necessary for use of the Content in the manner permitted by this Agreement have been obtained. Please note that you are responsible for any changes to the content (through the use of editing software or other changes).

Disclaimer for content marked as “editorial”. For Content marked as “editorial”, Corsica-Outdoor guarantees that the Content does not infringe any copyright or moral rights of the owner or creator of the content, but grants no rights and makes no warranties as to the use of names, persons, trademarks, trade dress, logos, registered, unregistered or copyrighted designs, artwork or architecture depicted or contained in the Content. In these cases, you must determine on your own responsibility whether in connection with your desired use of the content marked as “editorial”.

Releases or approvals are required and must procure the required releases themselves. You acknowledge that there are generally no releases for Content marked as “editorial” and that some jurisdictions provide legal protections against the commercial use of an individual’s image, appearance, or property unless that person approves has granted.

Caption/Metadata Disclaimer. Although we have made reasonable efforts to categorize and provide keywords, captions and titles for the content, Corsica-Outdoor does not guarantee the accuracy of this information or the metadata provided with the content.

Please note, however, that these warranties do not apply to: (1) fees payable to you (or a distributor of the work) under the terms of any master license or other written agreement between you (or the distributor) and a performing, mechanical or other rights management company that collects and administers royalties or similar remuneration to writers (a “Collecting Society”); (2) fees to the extent that they arise from the use of other content; and (3) fees, levies or other remuneration the collection of which is reserved exclusively for a collecting society under local law, regardless of the membership or contractual mandate of a writer or other rights holder.

No other warranties. Except for the “Warranty of Non-Infringement” provisions above in this Section, the Content is provided without warranty or representation of any kind, express or implied. Corsica-Outdoor makes no warranty that the Content will meet your expectations or requirements, or that its use will be uninterrupted or error-free.

    

Release/Limitation of Liability.

Your obligation to release Corsica-Outdoor. You agree to defend, indemnify and hold harmless Corsica-Outdoor and Corsica-Outdoor’s affiliates and suppliers and their respective officers, directors and employees from and against all damages, liabilities and costs (including reasonable litigation costs, including attorneys’ fees), arising out of or in connection with any actual or alleged breach by you (or any person acting on your behalf) of this Agreement.

Corsica-Outdoor’s obligation to indemnify you. Provided the Content is used only in accordance with this Agreement and you do not otherwise breach this Agreement, and as your exclusive and sole remedy for any breach of the warranties set forth above, Corsica-Outdoor will be bound by the terms of those Section to defend, indemnify and hold harmless you, your parent company, subsidiaries and affiliates and their respective officers, directors and employees from and against all damages, liabilities and costs (including reasonable legal costs, including attorneys’ fees) arising out of or related to in connection with an actual or alleged breach of the warranties under Section 9(a) above by Corsica-Outdoor. This indemnification obligation does not apply to the extent that the claim for damages, costs, or loss is based on your modifications to the content or the context in which you use the content. Furthermore, this indemnification obligation does not apply to any continued use of content by you after receipt of a corresponding notification from Corsica-Outdoor or after you have become aware that claims have been made regarding the content for infringement of third-party rights.

Aggregate Limitation of Liability. Unless you have purchased an Extended License, Corsica-Outdoor’s total maximum liability (meaning the total amount for which Corsica-Outdoor is responsible under this Agreement or any other agreement for the same Content) is limited to €5,000 per Content. This limit applies regardless of how many times you license the same content from Corsica-Outdoor. Under an Extended License, this amount increases to €25,000 per Content. Please contact Corsica-Outdoor if you require a higher exemption amount.

The party requesting the indemnification must promptly notify the other party in writing of the claim. The indemnifying party (the party who bears the costs) shall have the right to assume the negotiation, settlement, or defence of the claim or dispute. In such event, the indemnified party (the party not bearing the costs) shall cooperate with the indemnifying party in a reasonable manner. The indemnifying party shall not be liable for any legal costs, including attorneys’ fees and other costs, incurred prior to being notified by the other party of the claim for which indemnification is sought.

Limitation of Liability. CORSICA-OUTDOOR AND ITS LICENSORS WILL NOT BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR SIMILAR DAMAGES, EXPENSES OR LOSSES ARISING OUT OF OR ARISING FROM THIS AGREEMENT, EVEN IF CORS ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, EXPENSES OR LOSSES. IN SOME JURISDICTIONS THE EXCLUSION OR THE LIMITATION OF IMPLIED WARRANTIES OR NOT ALLOWED LIABILITY.

    

General Provisions.

Assignment. This Agreement applies only to you and is not transferrable without Corsica-Outdoor’s prior written consent. Corsica-Outdoor may assign this Agreement to any affiliate or successor in title without notice or consent to the extent that such entity agrees to be bound by these Terms.

Audit/Declaration of Conformity. You agree to provide Corsica-Outdoor with sample copies of Projects and End-User Uses containing Licensed Content upon reasonable notice. This includes free access to paid or otherwise restricted websites or platforms on which content is played. In addition, upon reasonable notice and in its sole discretion, Corsica-Outdoor, either through its own employees or through third parties, may review your records directly related to this Agreement and your use of the Content to verify compliance with the terms of this Agreement. If an examination reveals that you have underpaid Corsica-Outdoor by at least five percent (5%) of the amount owed, in addition to paying the difference, you are also obliged to reimburse Corsica-Outdoor for the costs of this examination. You agree to provide Corsica-Outdoor, upon request, with Corsica-Outdoor, in cases where Corsica-Outdoor has reason to believe that Content is being used in a manner not in accordance with the agreement, a certificate of compliance signed by an officer of your company in an e-mail issued by Corsica-Outdoor provide the form to be approved.

Electronic Storage. You agree to retain the copyright symbol, the Corsica-Outdoor name, the Content identification number, and any other information that may be embedded in the electronic file containing the original Content, and to maintain appropriate security measures to protect the Content against unauthorized use by to protect third parties. You may make one (1) backup copy.

Governing Law/Arbitration. This Agreement is governed by the laws of the Federal Republic of Germany to the exclusion of conflict of law’s provisions and principles. All disputes arising out of or relating to this Agreement shall be finally settled by binding, confidential arbitration by a single arbitrator. The arbitration process and selection of the arbitrator will be conducted in accordance with the provisions of JAMS’ Expedited Procedures in the Comprehensive Arbitration Rules and Procedures (“JAMS”) if you are located in North America, or the International Centre for Dispute Resolution (“ICDR”) or .JAMS, if you are located outside of North America (although you may choose which of the foregoing provisions shall apply), in the version in effect at the commencement of the arbitration and in one of the following jurisdictions (whichever is applicable to you is closest): New York (New York, USA), London (UK), Paris (France), Munich (Germany), Madrid (Spain), Milan (Italy), Sydney (Australia), Tokyo (Japan) or Singapore . The arbitration will be held in English and all documents will be presented and filed in English. The arbitrator’s decision is final and binding on the parties. On the basis of the arbitration award, recognition can be obtained from any competent court and enforcement can be pursued. This Agreement is not governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG). The losing party shall reimburse the prevailing party’s reasonable legal costs, including attorneys’ fees, for those parts of the action in which it lost. Conflicting cost decisions will be offset. Regardless of this, Corsica-Outdoor is entitled to initiate or continue legal measures in competent state courts in order to obtain a provisional measure against you obtain legal protection or other judicial decisions if, in Corsica-Outdoor’s opinion, such action is necessary or desirable to protect Corsica-Outdoor’s intellectual property rights. The parties agree that, notwithstanding any otherwise applicable statute of limitations and limitations, the commencement of arbitration must occur within two years of the act, incident, or event to which the claim relates.

Severability Clause. If any provision of this Agreement is found to be invalid, illegal or unenforceable in whole or in part, the validity, legality and enforceability of the remaining provisions shall not be affected. Such provisions will only be modified to the extent necessary for their enforceability.

Waiver. No action by either party other than an express written waiver shall be construed as a waiver of any provision of this Agreement.

Completeness clause. No provision of this Agreement may be added or removed unless such change is made in writing and accepted in writing by both parties or electronically executed by Corsica-Outdoor and subsequently accepted by you in writing. In the event of any conflict between the terms of this Agreement and the terms of any Purchase Order submitted by you, the terms of this Agreement shall prevail.

Notifications. Notices required to be sent to Corsica-Outdoor under this Agreement should be emailed to bjoern.schmiedel@corsica-outdoor.org. All notifications to you will be sent by email to the email address specified in your user account.

 

Steer.

You agree that you shall be solely responsible for paying all sales taxes, use taxes, value added taxes and fees incurred in any jurisdiction as a result of the license granted to you or your use of the Licensed Content.

Interest on overdue invoices. If you do not settle an invoice in full within the specified payment period, Corsica-Outdoor is at liberty to charge a processing fee of 1.5% per month (or a correspondingly lower percentage, if the legal regulations stipulate the above) until payment is received percentage).

Fees and Contract Renewals. If AUTOMATIC LICENSE RENEWAL is enabled for your subscription, you authorize Corsica-Outdoor to collect the applicable subscription fees at the then applicable fees and taxes for the subscription from your credit card, details of which are on hand when the subscription expires. You can change the automatic license renewal settings in your Corsica Outdoor account. Your subscription can only be cancelled as specified in the relevant section. Corsica-Outdoor may deactivate your subscription without notice if Corsica-Outdoor is unable to collect payment from your provided credit card details.
